1. This Presale is only open to residents of the United Kingdom who are aged 18 or over.
2. 2 (two) Presale Periods: 12.00pm BST on 18.08.2020 & 12pm BST on 20.08.2020. The presale will run from 12pm BST until all codes have been claimed or from 12pm BST until 7pm BST on the day of the presale event. Redemption of the code and purchase of the bar on Cadbury Gifts Direct runs from 18.08.2020 – 31.08.2020.
3. Moderation: @CadburyUK reserves the right to reject entries which, in its reasonable opinion:
a. contain any material which: (i) is offensive and/or derogatory, (ii) is of an explicit and/or sexual nature, or (iii) is defamatory, libelous, obscene or disparages the Promoter in any way, or (iv) is otherwise illegal;
b. contain any material which violates any third party intellectual property rights (including, but not limited to, copyright, trade marks, or any other proprietary or personal right);
c. contain any trade/brand logos or references other than incidental inclusion and/or relating to the Promoter’s products; and
d. Promotes any political agenda.
4. First 5,000 individuals on each presale to tweet @CadburyUK and #TwirlOrangePresale will be eligible to purchase a Twirl Orange ahead of the national launch on 07.09.2020.
5. How to Enter on 18.08.2020: Individuals can only enter the presale via Twitter. To join, at 12pm BST on 18.08.2020 the individual must do a tweet including @CadburyUK and #TwirlOrangePresale. The first 5,000 individuals (or Twitter handles) to tweet these will then be eligible to purchase a Twirl Orange and sent a congratulations message informing them of the fact. Those who tweet after the first 5,000 tweets will be sent a commiseration message informing them of the second presale on 20.8.20. Both the congratulations and commiseration message will be visible only to the individual who tweeted. Users may enter as many times as they wish but each twitter handle is only eligible to successfully join the presale once.
6. Product Purchase 18.08.2020: After the first 5,000 users have been sent their congratulations message, they will then receive another dark tweet with a unique redemption code and link to the Twirl Orange landing page. If they retweet this message, they risk another individual using their code. Once they go to the landing page, they will be taken through to the Cadbury Gifts Direct website to buy their Twirl Orange. When redirected to the Cadbury Gifts Direct site, the individual will join the website queue. Once they have reached the front of the queue, they will arrive at the Twirl Orange product page. The product page outlines the fact that the UK postage will be covered and that the total cost will be donated to charity. Once there, the individual can put the Twirl Orange in their basket, proceed to checkout, input their unique redemption code and pay 69p for the Twirl Orange (a Twirl Orange, commemorative Presale card & badge will also be included). The unique code can only be used in the discount box once. If not redeemed once input into the discount box, the code becomes invalid.

9. You will be charged the price of 69p for the Twirl Orange at the time of placing the Pre-Order. Methods of payment accepted are: (1) Debit Card Payment (2) Credit Card Payment (3) PayPal.
10. Postage will only be covered when purchasing the Twirl Orange bar and nothing else from the Cadbury Gifts Direct site. Postage will be by standard Royal Mail post. Delivery is subject to Cadbury Gifts Direct terms and conditions.
11. Donation: all earnings from this presale will be directed to a Mondelez International (MDLZ) approved charity.
12. When placing a pre-order for Twirl Orange, you will be required to provide certain information, such as your address and other billing information. You represent and warrant that all such information is accurate, and you shall ensure that such information is kept current. MDLZ shall have no responsibility or liability for inaccurate information or information that later becomes outdated, and shall have no obligation to make efforts to determine the correct contact or shipping information.
13. MDLZ has full discretion over the Presale, and any decision of MDLZ in all matters is final and binding and no correspondence will be entered into.
14. No responsibility can be taken for tweets which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. MDLZ does not guarantee continuous or secure access to Twitter.
15. This Pre-sale is in no way sponsored, endorsed or administered by or associated with Twitter. You are providing information to MDLZ and not to Twitter.
16. MDLZ together with any associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Presale except for any liability which cannot be excluded by law. Nothing will exclude MDLZ’s liability for death or personal injury as a result of its negligence.
17. An entry must be made directly by the individual entering the Presale. Bulk entries from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries and entries submitted by macros or other automated means together with entries which do not satisfy the requirements of these Terms & Conditions in full will be disqualified and will be not be counted. If it becomes apparent that an individual is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that individual’s chances in the Presale in a way that is not consistent with the rules of the Presale, that individual’s entries will be disqualified and any entry will be void.
18. Should an act, omission, event or circumstance occur which is beyond the reasonable control of MDLZ and which prevents MDLZ from complying with these Terms & Conditions MDLZ will not be liable for any failure to perform or delay in performing its obligations.
19. MDLZ and Cadbury Gifts Direct shall comply with all applicable requirements of the Data Protection Act 2018, the General Data Protection Regulation 2016 and any successor legislation or other applicable law. The personal information individuals provide will be used by the Promoter for the purpose of conducting this Presale and in accordance with the MDLZ’ Data Privacy Notice which can be found at www.cadbury.co.uk/privacy. MDLZ may disclose individuals’ personal information to its contractors and agents to assist in conducting this Presale (including any relevant activity) or communicating with individuals.
20. If any provisions of these Terms & Conditions are judged to be invalid, illegal or unenforceable, this will not affect or impact the continuation in full force and effect the remainder of the provisions.
21. By entering this Presale, you will be deemed to have agreed to be bound by these Terms & Conditions.
22. In the event of a discrepancy between these Terms & Conditions and the details in any presale material, the details in the Terms & Conditions will prevail.
23. These Terms & Conditions are governed by English law and their interpretation and application will be subject to the exclusive jurisdiction of the courts of England and Wales.
