Milk Tray Mission - Terms and Conditions

How to Apply

1.Applicants must be over the age of 18 and be a resident in the UK or Republic of Ireland. Directors, management and employees and their immediate families of the Promoter or the agencies or companies associated with this promotion are ineligible to enter.

2.The Application process will be open from 00:01 on Monday 2nd October 2017 and will run for a total of 47 days until 23:59 on 17th November 2017 (“Applications Deadline”).

3.Applicants will need to have internet access and a valid email address to apply for the role and no product purchase is necessary. Only one application per person is permitted. Applications should be received from the applicant themselves and applicants are not allowed to apply on behalf of a chosen nominee.

4.Applicants will need to complete the application form on www.Cadbury.co.uk/MilkTray by the Applications Deadlines. All mandatory fields (‘Who’ and ‘Why’) must be completed in order to submit a successful application.

5.Applications must reference a thoughtful gesture for somebody else as opposed to a ‘thank you’ moment in order for their applications to be deemed successful for the first stage. Applicants will be required to outline who they would like to deliver a box of Cadbury Milk Tray to (the Mission) and why. Overall, there must be a newsworthy element to the Mission, with a compelling story that’s joyful, entertaining, inspiring and emotive.

6.A follow up email will be sent to all applicants immediately after submitting their application form to advise that their application has been successfully received and requesting further information from them for their chance to go further. This further information will consist of five questions to be answered and submitted via clicking on the unique URL within their email by the deadline mentioned in the email. Applicants need to complete the second stage application form in order to qualify for Milk Trayning.

7.Applicants must ensure their application and responses do not contain anything sexual, derogatory, offensive or discriminatory nor any material which violates any third party intellectual property rights (including, but not limited to, copyright, trade marks, or any other proprietary or personal right), any responses found to contain any of the above shall be disqualified from the process.

8.A short list of successful applicants and subsequently the successful applicant (“Winner”) will be chosen by a panel of judges based on the qualities the Promoter is looking for in the Milk Trayning recruits which form the criteria for a winning entry. For applicants, these include being an interesting contrast to the Milk Tray Man and the fulfillment of their mission should feel unexpected and original. For the recipient (s), these include there being a variety between the Missions. Overall, there must be a newsworthy element to the mission with a compelling story that’s joyful, entertaining, inspiring and emotive.

9.Applicants must ensure that the information contained within the complete application form is accurate and truthful. Applicants may be disqualified from the application process if it is discovered that the applicant has supplied untruthful, inaccurate, misleading and/or fraudulent personal details.

10.The Promoter may choose to host a casting (either via telephone, through online or in person) where all shortlisted applicants will be invited to participate and provide more information on why they would like to be selected. Should a casting be necessary all shortlisted applicants will be informed by 31st December 2018 – no alternative date will be available to those applicants that are not able to attend this pre-set casting. All applicants shall cover their own travel and accommodation expense should they be required to attend the casting in person, or any other costs of personal nature incurred for attending the casting. All casting attendees must provide valid photographic ID and any other information required of them, as notified by the Promoter.

11.Should the casting day be postponed / called off for any reason, applicants shall be notified at least 24 hours in advance, the Promoter shall not be liable for any costs associated with such. Should an alternative date be fixed, applicants shall be given at least 48 hours’ notice of the new date and location.

12.By taking part in the casting day, all applicants agree to be filmed, photographed and/or interviewed and give the Promoter their consent for such content to be used in any format and distributed in perpetuity by way of any mechanism on a worldwide basis.

13.The Winner will be contacted via telephone and/or email by 30th January 2018 . Only Winner will be notified.

The Prize

14.There is a minimum of two prizes available to be won. The prize is the honour of being trained by the Milk Tray Man, and to assist in carrying out a Mission to deliver a box of Cadbury Milk Tray to an individual of the winners’ choice.

15.The Mission will be based on the thoughtful gesture which was detailed in the Winner’s original application, however, the Winners acknowledge and agree that the Promoter shall have the right to make any adjustments as necessary in its absolute discretion when fulfilling and executing such Mission.

16.Winner(s) will be chosen by a panel of judges based on the creativity and the qualities that the Promoter is looking for in the Milk Trayning recruits (overall, there must be a newsworthy element to the mission with a compelling story that’s joyful, entertaining, inspiring and emotive. Ideas must be original and creative)..

17.The chosen Winner(s) shall be required to participate in both advertising and marketing activities which may include:

  • a.PR opportunities including media interviews, photo-shoots, provide quotes for press materials;
  • b.Advertising: star in the new Cadbury Milk Tray television advert and associated marketing campaign;
  • c.Media partners: Feature in various media partners communications; and
  • d.Social media: To feature in content that is posted and promoted across the Mondelez owned social media channels. (collectively the “Marketing Activities”)


18.The Winner will not be remunerated for their participation in any advertising and marketing activities and assigns to Promoter all rights, including all copyright and other intellectual property rights, that may arise in materials or other content created during the advertising and marketing activities in relation to the Prize which shall be vested and owned by the Promoter in the world in perpetuity. Should they be required the Winner will ensure they are available at such times and such locations as may reasonably be required to fulfil their role in the Milk Trayning campaign. The Promoter, or its agency, shall ensure the Winner is given sufficient notice of such to enable them to make arrangements to attend.

Role Requirements

19.Applicants should not have any criminal convictions and / or convictions not spent, other than driving offences which have not resulted in a ban or a more serious sentence. CRB checks may be performed on successful applicants, therefore, anyone found to have given false information in their application form will be disqualified.

20.Certain parts of the Prize may require particular levels of health or fitness depending on the mission. Participants should ensure that they are capable of meeting the required standards.

21.For a period commencing on 2nd October 2017 and expiring 3 months after completion of the Marketing Activities (as confirmed by the Promoter or its agency), applicants should not have any contractual arrangements or commitments in place with any other confectionery company, including, but not limited to: Nestle, Mars, Ferrero, Lindt and Haribo, for the provision of any talent services or in respect of their name, likeness, image of biography.

General Terms and Conditions

22.The Promoter reserves the right to verify the eligibility of applicants. The Promoter may require such information as it considers reasonably necessary for this purpose and may withhold the winner’s prize until the Promoter is satisfied with the verification.

23.All applications must be made by the applicant themselves, bulk applications made from trade, consumer groups or third parties will not be accepted. Incomplete or illegible applications, applications by macros or other automated means (including systems which can be programmed to enter), and applications which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted.

24.The Promoter has ultimate discretion to select the winning applicant and the panel of judge’s decision is final. The Promoter may, in its sole discretion, disqualify applications deemed to be non-compliant with these terms and conditions and the Promoter reserves the right to refuse entry to or disqualify any applicant whose conduct may be unlawful or otherwise bring the Promotion into disrepute. In the event of such disqualification the Promoter may award the applicable prize to another applicant.

25.The Winner agrees to comply with the reasonable requests of the Promoter and its agency, and will act within the framework of acceptable and proper behaviour during the course of the fulfilling the Prize. The Winner will comply with any rules implemented by the Promoter and its agency and shall assist and cooperate with the Promoter and its agency in carrying out the mission.

26.No responsibility is accepted for applications lost, damaged or delayed or as a result of any network, computer hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt.

27.The personal information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. The Promoter is bound by the Data Protection Acts (1984 and 1998). Entrants can request access to the personal information the Promoter holds about them by contacting Interactive Manager, Bournville Place, Bournville Lane B30 2LU. The Promoter’s privacy policy is available on the Promoter’s website at www.cadbury.co.uk.

28.The Promoter cannot accept any responsibility for any damage, loss, injury suffered by any applicant entering the promotion or as a result of accepting or participating in any prize. Nothing shall exclude the Promoter’s liability for death or personal injury as a result of its negligence or generally for intent as well as for gross negligence.

29.If for any reason the Promotion is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the promotion.

30.In the event for any reason the Prize winners do not take an element of the Prize at the time stipulated by the Promoter, then that element of the Prize will be forfeited by the winners and neither cash nor any other form of compensation will be supplied in lieu of that element of the Prize. If for any reason a Prize is not available, the Promoter reserves the right to substitute another prize for it, in its sole discretion, of equal or higher value.

31.The decision of the Promoter regarding any aspect of the promotion is final and binding and no correspondence will be entered into.

32.By entering this promotion, all participants will be deemed to have accepted and be bound by these terms and conditions.

33.This promotion is governed by English Law and participants submit to the exclusive jurisdiction of the English courts.
