Terms of the Competition
1. The Competition is open to residents of the United Kingdom, Channel Islands and Isle of Man, aged 18 and above, excluding employees of Cadbury Schweppes group companies and agencies involved in the promotion and their immediate families.
2. Entries must be received no later than midday (BST) on Tuesday 11th April 2006. All entrants must complete a registration form. Maximum 3 entries per entrant. Each performance should last no longer than five minutes.
3. By submitting an entry, you confirm that:
a. it is a recording of a performance of your own original work (words, music); in producing the work you have not copied any material which may belong to another person in such a way as to infringe their rights; and you have not granted any rights in the work, or in your performance of it, to anyone else; where there is more than one performer, authorship of the work will be attributed to all listed performers, unless CTB is expressly notified otherwise on registration and each performer hereby agrees not to assert any moral rights against CTB in respect of such attribution;
b. you consent to CTB editing the recording of your performance and using it or any part of it at any time and in any part of the world in connection with the promotion of Cadbury Creme Egg, making copies of the recording and distributing them to the public, including the recording in a cable service programme, and allowing third parties to do the same, in particular but without limitation, by (i) incorporating the recording in one or more podcasts to be made available via subscription and/or download to visitors to the cadbury.co.uk site, using any form of digital equipment (including mobile phones); and (ii) uploading the recording to the iTunes online music store to be made available to its visitors for download;
c. you acknowledge that you will not be entitled to any payment in respect of your performance or the use of the recording by CTB or anyone to whom CTB makes the recording available, irrespective of the use to which it is put;
d. you consent to CTB indicating your name, and the title of your performance on its website (and to the uploading of the same information to the iTunes store);
e. you acknowledge that whilst CTB stipulates that authorised use of the podcast by visitors to its site is limited to personal, non-commercial use, CTB shall have no responsibility to detect or pursue on your behalf any unauthorised use of the recording by any third party;
f. you acknowledge that CTB has absolute discretion as to whether or not it uses the recording and is under no obligation to do so.
4. Notwithstanding any provision in the cadbury.co.uk Terms of Use, if the material (words, music) is your own original work, you will still own the copyright in it and will still be able to use it as you wish.
5. Where an entry involves more than one performer, references in these Terms to “performer”, “entrant”, “finalist” and “winner” shall be read as references to “performers”, “entrants”, “finalists” and “winners” and “you” and “yours” shall be construed accordingly. In accordance with the authorisation referred to in the registration form, Cadbury Trebor Bassett (“CTB”) shall be entitled to communicate only with the designated representative of any group of performers in connection with their participation in the Competition.
6. Up to six entries will be selected for inclusion in each of four My Way Podcast episodes to appear on cadbury.co.uk on 4th, 7th, 11th and 13th April 2006. The selections will be made as entries are received by a judging panel (which will include at least one non-Cadbury member) and will be made on the basis of originality and quality of the work. Each selected entrant will be contacted by email and will receive a 3-pack of Cadbury Creme Egg.
7. Entries which appear to include non-original, obscene, offensive or defamatory material will not be considered for selection. The panel’s decision on selection is final and no correspondence will be entered into.
8. Following the launch of each Podcast episode, visitors to cadbury.co.uk will be able to vote online for their favourite performance of that episode for a limited period until the next scheduled episode appears. Voters may only cast one vote per browsing session.
9. For each Podcast episode, the performer with the highest number of votes cast will become a “finalist” and his/her performance will appear in “the final” to be included in a further Podcast episode on 18th April 2006. Visitors to cadbury.co.uk will then be invited to vote for their favourite finalist up to midday (BST) on 24th April 2006. The finalist with the highest number of votes cast in this last round of voting is the winner of the Competition. The winner will be notified by email and his or her name announced on cadbury.co.uk on 25th April 2006, the date on which the winning performance will be featured in the final My Way Podcast episode. The dates of Podcast episodes may be varied at CTB’s discretion.
10. If, in any round, two or more performers carry equal highest votes, the judging panel will select a finalist (or winner) from amongst them based on the above criteria and their decision will be final.
11. CTB reserves the right to disqualify and withdraw any entry from the Competition at any time (whether before, during or after voting) if CTB has reason to believe that any third party rights have been or may be infringed. In such circumstances, CTB shall determine in its discretion how the Competition is to proceed.
12. There is one prize, which consists of an hour-long consultation with a London showbusiness agent, Anthony Blackburn of Blackburn Sachs Associates. The prizewinner will be responsible for arranging his/her own travel to and from London. There is no cash or other alternative to the stated prize. If the prize is won by a group of performers, the consultation shall relate to the group. CTB reserves the right to vary details of the prize in the event of circumstances beyond its control.
13. The winner’s name will be available on request to those enclosing a stamped addressed envelope to The UK Internet Manager, Cadbury Trebor Bassett, Franklin 4, Bournville Lane, Birmingham, B30 2NB for a period of 28 days from 25th April 2006.
14. The winner and finalists may be required to take part in further publicity.
15. Selected entries may remain available for downloading from the cadbury.co.uk archive for a period after announcement of the winner of the Competition.
16. No purchase necessary.
